Judicial Expert Assessments, future Evidence

In all instances, the essential objective is to formally document defects, establish their causes, and determine viable remediation methods—along with associated costs—in accordance with professional standards.

Judicial Expert Report

A judicial expert report is commissioned by a judge or court as part of legal proceedings. It must provide objective technical evidence to assist the judge in making an informed decision. The expert report must adhere to strict procedures and involves a complex process. Its findings carry official weight in court.

Technical Expert Report

A technical expert report is commissioned by one of the involved parties or an insurer under an agreement. Its purpose is to determine the cause of defects, estimate the scope of required works or obtain an analysis report or neutral conclusions. A key advantage is that it provides guidance and facilitates mediation, potentially leading to an out-of-court settlement. Since 1 January 2025, technical expert reports can be submitted as evidence in potential legal proceedings and are recognised by Swiss courts.
